Apply for a divorce in Ukraine
In accordance with the current legislation of Ukraine there are two ways to dissolve a marriage:
  • 1 Apply for a divorce in the nearest registry office.
  • 2 Through the courts.
Submission of documents to the court is carried out in the presence of minor children or disagreement on the divorce of one of the spouses. With mutual consent and no claims to each other, the divorce procedure begins after a joint visit to the relevant authorities. If the couple has disputes and disagreements, then there is a need to prepare a claim.

Stages of applying to the registrar

If a final and mutual decision is made to dissolve the marriage, then at the initial stage it is required to find the nearest registry office at the place of residence of one of the spouses and sign up to the inspector. He sets the time of the visit and, if necessary, provides advice. In many cities of Ukraine this procedure can be carried out online at specialized sites. In this case, it is necessary to carefully fill in the questionnaires and provide reliable information.
After recording, the inspector should prepare a package of documents:
  • passports of both spouses;
  • identification tax numbers;
  • certificate of registration of a marriage union.

Both parties must file for a divorce. But the document is filled only by an inspector, not a spouse. The receptionist will carefully review the documentation provided. How to file a divorce petition

Most of the claims for divorce are filed with the judicial authority, which is located near the respondent’s residence. But according to Article 28, paragraph 2 of the Code of Civil Procedure of Ukraine, the jurisdiction of the case upon divorce can be determined by the claimant at the place of his registration if the child lives with him. Also, the place of consideration of the case can be determined by agreement between the parties.

Requirements for a claim for divorce contains Articles 151, 175, 177 of the Code of Civil Procedure of Ukraine.
To apply for a divorce, you must also attach the following copies of documents:
  • copy of marriage certificate;
  • copy of the passport;
  • spouse identification tax numbers;
  • a copy of the birth certificate of children, if any;
  • a copy of the court application fee.

The cost of a divorce

In 2019, the court fee in the case of divorce is 768.40 UAH. You also need to add a bank commission for making 15.00-20.00 UAH.
It is worth noting that in a divorce in court, in many cases, the assistance of an experienced family lawyer is necessary. Lawyers are accompanied by material costs.

In some situations it is impossible to divorce

According to the current legislation of Ukraine it is impossible to file for a divorce in two cases:
  • in the presence of pregnancy with the spouse;
  • if the family has a child who is under 12 months old.
Exceptions are situations that are provided for by the norms of the Family Code of Ukraine:
  • the acting spouse is not listed in the birth certificate as a father;
  • another man acknowledged the paternity of an unborn or already born child;
  • unlawful actions against the second spouse.
