Joint children are those who appeared during the current marriage, or both spouses are indicated in their birth certificate. In the presence of a common child, a divorce is possible only through a court. The point is that the state's goal is to ensure the well-being and normal conditions for the development of the younger generation. Therefore, the spouses can solve all the issues related to the upbringing and provision of children before the divorce. For this purpose, an agreement "On the upbringing and provision of a child after the dissolution of the parents' marriage", which regulates these issues, is drawn up.

How to get a divorce if you have children?

  • application for divorce;
  • copy of the passports;
  • copy of the birth certificates of children;
  • a copy of the marriage certificate;
  • a copy of the tax number assignment certificate;
  • paid receipt of state duty;
  • the contract "On the upbringing and provision of the child after the dissolution of the marriage of the parents" (when filing a joint application).

Next, the date of the court session is appointed - not earlier than a month. Participants in the process are notified of the place and time of the trial. If someone could not appear on time for a hearing for a good reason and at the same time notified the court, the meeting could be postponed. At the conclusion of the court a decision is made, which is a document confirming the divorce. Also, the couple will still need to look at the Department of Registration of Civil Status Acts in order to put a stamp on the divorce in the passport in the form of a book, in the passport in the form of an ID-card the stamp is not put.

What it is necessary to divorce without the consent of the spouse?

For the dissolution of marriage at the request of one of the spouses it is necessary to draw up a statement of claim. This document is the basis for the commencement of divorce proceedings. A claim is made in accordance with the norms established by law. In addition to this document, the court is to:
  • copy of the passport;
  • copy of the child's birth certificate (if any);
  • a copy of the marriage certificate;
  • a copy of the tax number assignment certificate;
  • paid receipt of state duty/

The package of papers is served in two copies. In the claim it is necessary to indicate the address of the residence or work of the defendant. There will be sent a notice of the beginning of the divorce proceedings. The court date is also, as in the previous case, appointed no earlier than 30 days from the date of submission of documents. After the judge makes a decision, it is possible to appeal it within 30 days. At the end of this period, it is gaining legal force.
